ドメイン名紛争に係わる裁判管轄及び対物訴訟の最新動向 Sallen v. Corinthians Licenciamentos LTDA, 273 F.3d 14(1st Cir. 2001), 2001 U.S. App. LEXIS 25965--ドメイン名紛争に関するUDRP(統一ドメイン名紛争処理方針,Uniform Domain Name Dispute Resolution Policy, ADRの1つ)のWIPO裁定(申立人への移転命令)を不服として,ドメイン名登録者が合衆国地方裁判所に出訴したところ,地方裁判所は,両当事者間に連邦法であるACPA法(米国反サイバースクワッティング消費者保護法,Anticybersquatting Consumer Protection Act)に依拠する実質的な争点(actual controversy)が存在しないとして,被告のMotion to Dismissを認容し,ドメイン名登録者からの訴えを却下した.ドメイン名登録者がこの地裁判決を不服として,さらに控訴したところ,第1巡回区合衆国控訴裁判所は,ACPA法の規定・立法経緯並びにUDRPの策定経緯等に照らして,合衆国裁判所はUDRPに敗訴したドメイン名登録者による確認請求等についての裁判管轄権があるとして,原審判決を棄却し,再審理のための差戻しを命じた
